Agreement to Terms

By accessing or using the services provided by RightTouch DeSoto Landscaping, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services. We reserve the right to update these terms at any time, and your continued use of our services after any changes constitutes acceptance of the new terms.

Services Provided

RightTouch DeSoto Landscaping provides landscaping services including but not limited to lawn care, landscape design and installation, hardscaping, irrigation systems, tree care, sod installation, outdoor lighting, drainage solutions, seasonal cleanups, commercial landscaping, mulching, and artificial turf installation. All services are subject to availability and scheduling. We reserve the right to refuse service to anyone for any reason at any time.

Estimates and Pricing

We provide free estimates for our services. All estimates are valid for 30 days from the date provided unless otherwise stated. Final pricing may vary based on site conditions, material costs, or changes requested by the customer. We will notify you of any price changes before proceeding with work. Payment terms will be outlined in your service agreement or invoice. Payment is due upon completion of services unless other arrangements have been made in writing.

Scheduling and Cancellations

We make every effort to complete work on the scheduled date. However, weather conditions, equipment issues, or other unforeseen circumstances may require rescheduling. If you need to cancel or reschedule a service, please provide at least 24 hours notice. Cancellations with less than 24 hours notice may be subject to a cancellation fee. For recurring maintenance services, either party may cancel with 14 days written notice.

Property Access and Safety

You agree to provide safe and clear access to the areas where work will be performed. You are responsible for marking or identifying any underground utilities, sprinkler lines, or other hidden hazards before work begins. We are not responsible for damage to unmarked utilities or obstacles. You also agree to secure pets and remove any items that may interfere with our work. If we cannot safely access the work area, we may reschedule the service.

Warranties and Guarantees

We stand behind the quality of our work. For installation services, we offer a limited warranty on workmanship as outlined in your service agreement. Plant materials and sod are guaranteed for a specified period, typically 30 to 90 days, provided that proper care and watering instructions are followed. Equipment installations such as irrigation systems include manufacturer warranties. Routine maintenance services do not include warranties, as results depend on ongoing care and environmental factors beyond our control.

Limitation of Liability

RightTouch DeSoto Landscaping carries liability insurance to protect our customers and our business. However, our liability is limited to the cost of the services provided. We are not responsible for indirect, incidental, or consequential damages arising from our services. In the event of any damage or issue, you must notify us within 7 days so we can assess and address the situation. We are not liable for damage caused by acts of nature, pests, disease, or improper care after service completion.

Customer Responsibilities

You are responsible for providing accurate information about your property and any specific requirements or concerns. You must disclose any known issues such as weak soil, drainage problems, or previous pest damage. After installation services, you are responsible for following any care instructions provided, including watering schedules and maintenance guidelines. Failure to follow these instructions may void warranties or guarantees.

Intellectual Property

All landscape designs, plans, and materials created by RightTouch DeSoto Landscaping remain our intellectual property unless otherwise agreed in writing. You may not reproduce, distribute, or use these designs for other projects without our permission. Any photos or videos taken of completed work may be used by us for marketing and promotional purposes unless you specifically request otherwise.

Dispute Resolution

If any dispute arises regarding our services, we encourage you to contact us directly so we can work toward a resolution. Most issues can be resolved through open communication. If a resolution cannot be reached, any disputes will be handled in accordance with the laws of the State of Texas. Both parties agree to make a good faith effort to resolve disputes before pursuing legal action.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on our website with an updated date. Your continued use of our services after any changes indicates your acceptance of the new terms. We encourage you to review these terms periodically to stay informed of any updates.
